Terms & Conditions - Cancellation, Rescheduling, Refunds, and No-Show Policy

1. Scope and Parties
1.1. This Policy governs all purchases, bookings, and subscriptions for English-language lessons, programs, workshops, and digital learning materials (the “Services”) offered by Gökhan Çetinyürür - LUSE English Global, registered at Istanbul, Türkiye ( “we,” “us,” “our”, "tutor"), via www.luseenglishglobal.com, www.luse-english.com and associated channels.
1.2. This Policy applies to consumers (“you,” “your”). Business-to-business arrangements may be subject to separate terms.
2. Booking and Timekeeping
2.1. Session Length: Duration of the sessions are stated within the service page of the related session.
2.2. Time Zone: All times are displayed according to your profile settings; if none are set, the default is Istanbul, Türkiye. You are responsible for verifying your local time.
2.3. Confirmation: A booking is confirmed only upon successful payment and receipt of our booking confirmation.
3. Rescheduling by You
3.1. Notice Period. You may reschedule a confirmed session up to 24 hours (1 calendar day) before the scheduled start time, subject to tutor availability.
3.2. Inside 24 Hours: Requests made within 24 hours of the start time are treated as late cancellations (see Section 5).
3.3. How to Reschedule. Please use your profile or reply to the confirmation email to create a verifiable, timestamped record.
4. Cancellations by You
4.1. ≥24 Hours Before Start: If you cancel at least 24 hours in advance of the session's starting time, the session is credited back to your plan for later use. No monetary refund is issued.
Sessions cancelled within 24 hours of the session's starting time are forfeited and not credited or refunded.
4.3. Credit Expiry: Credited sessions must be used within the validity period of your plan (see Section 8).
4.4. Packages and Subscriptions: The same rules apply to sessions booked under a multi-session package or subscription.
5. Lateness and No-Shows
5.1. Start and End Times: Sessions commence at the scheduled start and end at the scheduled end time. Sessions are not extended for late arrival.
5.2. Late Arrival: If you join late, you may attend the remainder of the session; no refund or credit applies.
5.3. No-Show: Failure to attend within 15 minutes of the scheduled start counts as a no-show and the session is forfeited.
5.4. Goodwill Exception: At our sole discretion, we may grant one goodwill re-credit per customer within any rolling 12-month period upon timely notice and reasonable evidence of an emergency.
6. Cancellations or Delays by Us
6.1. If we cancel a confirmed session within 24 hours of the session's starting time, you will receive an additional session credit returned to your plan or, at your request, a replacement session at no extra charge.
If we cancel a confirmed session more than 24 hours of the session's starting time, related session's credit will be returned to your plan or, at your request, a replacement session at no extra charge.
6.2. If we are more than 10 minutes late, you may choose a free reschedule or an additional credit.
6.3. For repeat provider-initiated changes (two or more within a rolling 60-day period), you may request a pro-rata refund of any unused package balance.
7. Technical Issues
7.1. Your Side. Connectivity, device, or software issues on your side count as attended time and do not entitle you to a refund or extension.
7.2. Our Side / Platform Outage. Where a verified outage prevents delivery for 10 minutes or more, we will reschedule or we will credit the session back to your plan.
8. Packages, Pricing Plans (Multi-Session Purchases)
8.1. Validity Period: Each package remains valid for the duration specified at the time of purchase (for example, 4-week, 8-week, or 3-month packages).
8.2. Start Date Selection: The validity period begins on the user-selected start date, which may differ from the purchase date. You may choose this date at checkout.
8.3. Credit Returns: Cancelled sessions under Section 4.1 are credited back to your active plan and may be rebooked at any time within the plan’s validity period.
8.4. Expiry: Once the plan’s validity period ends, any unused sessions expire automatically and cannot be refunded or reactivated.
8.5. Transfer: With our written consent, unused sessions may be transferred once to another named learner. Transfers are not retroactive.
9. Group Sessions and Workshops
9.1. Places are limited. Unless otherwise stated on the product page, cancellations after the starting time of the event are non-refundable.
9.2. If we cancel a group session or workshop, you may choose a reschedule or full refund/credit.
10. Subscriptions (If Offered)
10.1. Subscription billing cycles and inclusions are stated at checkout.
10.2. You may cancel future renewals at any time before the next billing date.
10.3. Unless required by law or explicitly stated, partial periods are not refunded once a cycle has started.
10.4. Any included sessions follow Sections 3–5 and 7–9.
11. Refunds: Method and Timelines
11.1. Method: Eligible refunds are returned to the original payment method.
11.2. Timelines: We process approved refunds promptly; your provider may require additional time to post funds.
11.3. Currency and Fees: Refunds are made in the original purchase currency. Where legally permitted, third-party processing fees and non-recoverable costs may be deducted and itemised.
If a student cancels an active subscription or package and a monetary refund is required under applicable law (for example, during the EU 14-day withdrawal period), the refund is calculated based on the full single-session price, not the discounted package price.
This means:

Completed lessons are charged at the standard single-session rate.

Any discounts applied to the package or subscription are removed.

Only the remaining balance (after deducting the full single-session value of completed lessons) is eligible for refund.
This ensures refund calculations reflect the actual value of delivered sessions rather than discounted package rates.
12. EU Right of Withdrawal (Cooling-Off)
12.1. General Rule: For online distance contracts, EU consumers generally have 14 days to withdraw without giving any reason. For services, the period runs from the day the contract is concluded.
12.2. Early Performance at Your Request. If you ask us to begin providing services during the 14-day period, you acknowledge that:
a) you will owe a pro-rata amount for services already provided up to the time you notify us of withdrawal, and
b) once a session has been fully delivered, the right of withdrawal no longer applies to that completed session.
12.3. Digital Content Not on a Tangible Medium. The withdrawal right may not apply once delivery has begun with your express prior consent and acknowledgment that you lose the right of withdrawal, as provided by the Directive and related guidance. We obtain such consent at checkout where applicable.
12.4. How to Exercise: To withdraw within 14 days, email info@luseenglishglobal.com with the subject “Withdrawal,” stating your full name, order number, purchase date, Services purchased, and your clear statement to withdraw. We will confirm receipt and calculate any pro-rata amount due per 12.2.
13. Chargebacks
13.1. Please contact us before initiating any chargeback. Where Services have been delivered, or where a late/no-show occurred under Section 5, we will dispute chargebacks with evidence of attendance, communications, and the terms of this Policy.
14. Conduct
14.1. We may terminate any session immediately, without refund, for abusive, harassing, or otherwise inappropriate conduct that compromises a safe learning environment.
15. Force Majeure
15.1. Neither party is liable for delay or failure to perform due to events beyond reasonable control (including but not limited to widespread platform outages, power failures, or natural disasters). We will offer a reschedule or credit once normal operations resume.
16. Changes to This Policy
16.1. We may update this Policy to reflect operational or legal changes. Material changes apply prospectively and will be posted with an updated “Last updated” date. For active subscriptions, we will give reasonable notice by email.
17. Dispute Resolution and ADR
17.1. The EU Online Dispute Resolution (ODR) platform has been discontinued. For current guidance and redress options, see the European Commission’s Consumer Redress resources or your national consumer body. We will consider reputable ADR/mediation providers upon request.
18. Governing Law and Consumer Protections
18.1. This Policy and your contract are governed by the laws of Republic of Türkiye, without prejudice to mandatory consumer protections in your EU country of residence, which continue to apply.
8. Notices and Correspondence
The Tutor operates under the Turkish Social Media Tax Exemption and does not maintain a physical office. All notices, correspondence, or other communications between the parties shall be made electronically via the following email address: info@luseenglishglobal.com. Any notice sent by email shall be deemed received on the date it was transmitted, provided no delivery failure notice is returned.
If required by law, the tutor’s correspondence address is Istanbul, Türkiye.
